Campson & Campson Law Firm Expresses Support for Grieving Families Act

Campson & Campson, a New York-based law firm, announces its support for the “Grieving Families Act.” The company has been providing litigation services for victims of cases related to accidents, abuse, and work injuries. Currently, the firm is working with the New York administration to sign the Grieving Families Act. According to the act, families are entitled to compensation for the emotional losses they experienced following the death of a loved one. It seeks to change the present law, which was passed in 1847 and states that families can only receive compensation for costs directly associated with the death of a loved one, like lost wages and funeral costs. Non-financial losses like pain and suffering are not taken into account by the current law.

The existing law also disregards the contributions of family members who may not have earned high wages. It also treats high salary earners as more important because they contributed significantly to the family’s finances before their deaths. The Grieving Families Act seeks to take into account any additional, non-monetary contributions the victim provided to the family.

The current law also ignores the contributions of family members who may not have been high-wage earners, such as children or disabled elders, treating high-wage earners as more valuable because they made significant financial contributions to the family before death.

Moreover, the existing law does not usually recognize other close relatives even if they were close to the deceased. It only allows select family members to get compensation. The proposed legislation would increase the number of family members who are eligible to file lawsuits to include spouses, domestic partners, parents, grandparents, stepparents, children, grandchildren, and great-grandchildren. A jury could decide who counts as a close relative.

“The Senate Bill S74A, also known as the “Grieving Families Act” (GFA) is set to vastly expand compensable damages in wrongful death actions. The current, archaic law has been on the books, with no updates, since 1847,” said Paul.
